MA SB 1855 – This Bill amends the law governing indemnification provisions in construction contracts by not allowing indemnitors or additional insureds to be liable for amounts greater than the proportional extent of their own negligence. RI HB 7765 – Scheduled for hearing and consideration March 25th. This Act would provide notice of a mechanics’ lien effective as to any retainage earned but not paid, for work furnished pursuant to section 34-28-1 et. seq. This notice of lien shall be effective from commencement of said work.
RI SB 2323 – Hearing held March 24th. This Bill creates a cause of action against sureties which wrongfully and in bad faith refuse to pay a claim or to perform timely their bond obligations. It also permits actions brought by an obligee, principal or claimant for compensatory damages, punitive damages, and reasonable attorneys’ fees. This Bill is similar to a bill introduced in the prior legislative session that failed and was opposed by NASBP, SFAA, and AIA.
NY HB 2457 – This Bill provides that whenever a municipal corporation issues a permit subject to compliance with section 220 of the Labor Law, such permits or its contractor or subcontractors furnishing workers shall post a payment bond subject to this section.
